MANILA -- The Court of Appeals has denied former senior superintendent Cezar Mancao’s bid to quash the murder charges filed against him in connection with the killing of publicist Salvador “Bubby” Dacer and his driver, Emmanuel Corbito.
In a six-page decision penned by Associate Justice Eduardo Peralta, the ninth division of the appellate court dismissed a petition that sought to overturn a Manila court ruling that rejected his demurrer to evidence. The latter means a court may dismiss the charges on the ground of insufficiency of evidence.
The CA noted that the Supreme Court has decided previously that the denial of a demurrer to evidence will depend on the discretion of a trial court.
The SC also noted that the appellate court “will not review in such special civil action the prosecution's evidence and decide in advance that such evidence has or has not established the guilt of the accused beyond reasonable doubt.”
Other personalities tagged in the double murder case include former Senator Panfilo Lacson, former Supt. Glenn Dumlao, and former Senior Supt. Michael Ray Aquino.
The SC earlier upheld a Court of Appeals decision clearing Lacson, who was alleged to have masterminded the killings.
