PNoy right on Cha-cha, but timing is wrong: law expert

MANILA – A Constitutional law expert believes that President Benigno Aquino III is right that there may be a need to clip the powers of the Supreme Court, but he said the timing for changing the charter is wrong.

Atty. Rudyard Avila III said the proposal for charter change would have been welcomed had he declared openness to it during the early part of his presidency when he was still enjoying high popularity ratings.

Avila added that a proposal for a charter change towards the end of a presidency would naturally attract criticisms.

Aquino has less than 2 years left in office.

Avila said there is also the impression that the recent tiff between the executive and judiciary, especially regarding the Disbursement Acceleration Program, triggered Aquino's change of heart.

''Kung pinropose ito bago ang decision sa DAP, at nung bago pa ang term, nobody would have suspected anything bad about it,'' he said.

Avila said he agrees with Aquino that the SC has wielded too much power under the current charter.

He said some constitutional experts opined in the past that the SC was exercising too much power after intervening in certain decisions of the executive.
