MANILA - The Supreme Court (SC) has directed the Sandiganbayan to file its comment on the petition of the former chief of staff of Sen. Juan Ponce Enrile, Atty. Gigi Reyes, to be released from detention and her plunder and graft trials halted.
In a two-page en banc resolution, the high court gave the Sandiganbayan Third Division 10 days to file its comment on Reyes' petition.
Reyes and Enrile stand accused for plunder and graft for allegedly pocketing millions in kickbacks and commissions from alleged "pork barrel" scam queen Janet Lim Napoles.
"Acting on the petition for certiorari and prohibition with prayer for the issuance of temporary restraining order and/or writ of preliminary injunction, the court resolved, without giving due course to the petition to... require the respondent to comment on the petition and prayer for TRO and/or writ of preliminary
injunction within 10 days from notice hereof," the resolution read.
The high court also ordered the consolidation of Reyes' petition with the separate petitions of Enrile and Senators Bong Revilla and Jinggoy Estrada, who also face similar charges.
Reyes, who is now detained at Camp Bagong Diwa in Bicutan, Taguig City, urged the high court to order the quashal of her arrest warrant and reverse the anti-graft court's ruling finding probable cause against her.
Reyes claimed she was denied due process and not furnished with all the sworn statements of witness Ruby Tuason while the cases were under preliminary investigation before the Office of the Ombudsman.
