MANILA - Atty. Gigi Reyes, the controversial former chief of staff of Senator Juan Ponce Enrile and Enrile's co-accused in the plunder and graft cases before the Sandiganbayan in connection with the pork barrel scam, filed another petition urging the Supreme Court (SC) to order her release from detention and halt her trial.
This, after the high court junked her supplemental petition which asked for the same relief, on the basis of procedural defects.
In her 19-page petition for certiorari filed Friday, the same day she was arraigned on plunder charges, Reyes urged the high court to issue a temporary restraining order (TRO) on the anti-graft court's resolutions that ordered her arrest and found probable cause against her.
On the merits of the case, Reyes sought the quashal of her arrest warrant and nullification of the probable cause ruling.
Reyes claimed she was denied due process during the preliminary investigation of the complaints before the Office of the Ombudsman, and not furnished with all the sworn statements and other evidence provided by prosecution witness Ruby Tuason.
Reyes also urged the SC to order that the cases against her before the anti-graft court be remanded to the Ombudsman for a continuation of the preliminary investigation proceedings, and that she be provided with all the evidence in connection with Tuason's testimony.
The high court earlier junked Reyes' supplemental plea, pointing out that the arguments raised did not supplement her original petition, rather, were new issues that assailed recent rulings of the Sandiganbayan.
