MANILA - The Supreme Court (SC) has dismissed lawyer Jessica “Gigi” Reyes’ petition seeking to invalidate her detention as a result of the pork barrel scam case filed before the Sandiganbayan.
SC spokesman Theodore Te said Reyes’ petition is procedurally defective.
He said Reyes did not file a “leave of court," which is necessary in seeking the high court’s action against her warrants of arrest.
Without a grant of the leave of court, a petition would be unlawful.
The high court also noted that the supplemental petition filed by Reyes was a “distinct” petition against the orders of the Sandiganbayan.
Reyes’ earlier petition asked the high court to stop the proceedings of the Ombudsman, which later found basis to file the plunder case against the former chief of staff of Senator Juan Ponce Enrile.
The court noted, however, that the dismissal of the petition is “without prejudice to her availment of the proper remedy.”
Reyes is now at a Bureau of Jail Management and Penology (BJMP) facility in Camp Bagong Diwa, Bicutan, Taguig after getting medical treatment and check-up at the Philippine Heart Center.
