MANILA – The Philippine National Police (PNP) cannot take Senator Juan Ponce Enrile out of the detention facility without the approval of the Sandiganbayan.

In an interview with dzMM, lawyer Harry Roque said the police should have obtained a court clearance first before agreeing to bring Enrile to the Asian Eye Institute in Makati on Saturday and Sunday.

Enrile has been “under the custody” of the PNP since Friday when he surrendered following the finding of probable cause in his plunder and graft case.

But Malacanang insists that the government is not giving any special favors for Enrile.

Communications Secretary Herminio Coloma Jr. said the government have to take into consideration each one’s rights, including Enrile.

- with reports from ANC
