MANILA - The camp of Senator Jinggoy Estrada filed a motion for bail hours after the Sandiganbayan ordered his arrest on Monday.
In the motion filed by his team of lawyers led by veteran lawyer Jose Flaminiano, the defense said the evidence of guilt is not strong.
Bail is not a matter of right in plunder cases. Bail hearings will have to be set, which could stall the trial proper.
In a motion for bail, the prosecution must prove that the guilt of the accused is strong.
Estrada reiterated on Monday he did not know that the recipients of his pork barrel funds were bogus non-government organizations (NGOs).
He blamed the implementing agencies for not checking the authenticity of the NGOs.
Estrada’s defense also says bail should be granted since the senator is not a flight risk.
Allowing the motion, however, may weaken the government’s case against Estrada.
