MANILA - Senator Alan Peter Cayetano said there is a strong chance that Senator Juan Ponce Enrile will be allowed hospital arrest.
Cayetano, who has criticized Enrile on many issues, said human rights are paramount in all instances.
“Dahil sa kalagayan niya bilang 90 years old, even sa Senado na malamig at may aircon, even ang kanyang mata o kanyang blood pressure, o minsan nahihilo. Sa konstitusyon natin, ang buhay ng tao ang palaging kina-count,” he said.
Enrile will still have to initially undergo the procedures that his colleagues, Senators Jinggoy Estrada and Ramon “Bong” Revilla Jr., went through.
“They still have to follow the normal process na hulihin pa din siya, sumuko pa din siya, dalhin pa din siya sa custodial area, pero any sign na may problema sa health ay dapat naman dalhin sa doctor,” he said.
The defense may file a motion for hospital arrest, which the Sandiganbayan will study.
Cayetano noted, however, that the same scenario and attention should be given to common prisoners.
The reality is that there is still a “senator” and an “ordinary” person even in jail, he said.
“We have to put our foot down as a nation and say na ito ang criminal justice system natin na kahit mayaman o mahirap, pantay-pantay ang turing. Napakalaking challenge sa atin yan. Bakit may custodial area sila na hiwalay sa ordinaryong kriminal? Ibig sabihin, pati ba sa kulungan, merong senador at merong hindi senador?”

He said he wanted to see Revilla but decided to go against it.
“Alam mo ang personal feelings ko talaga, dahil matagal kong kasama, gusto kong bisitahin. Kaya lang, we should also remember the victims of the crime. That is why I chose to visit today ang mga PNP, ang mga lumalaban sa corruption rather than sa mga nasasakdal. So I know in the past few days, panay ang human interest, alam kong mainit doon, alam kong mahirap makalaboso. Pero hindi ba sinasabi nga natin, if you can't do the time, don't do the crime,” he said.
