MANILA - Senator Juan Ponce Enrile moved to quash the warrant of arrest that has yet to be issued by the Sandiganbayan against him.
Days after asking the anti-graft court to allow him to post bail, Enrile filed a supplemental opposition Monday against the issuance of a warrant of arrest and for the dismissal of the graft and plunder charges filed by the Office of the Ombudsman.
His lawyers argued that he should have been informed of the nature and cause of the accusation. Enrile's camp claimed the allegations of kickbacks add only to the confusion.
The children of alleged pork barrel scam mastermind Janet Lim Napoles, meanwhile, also asked the court to defer the issuance of warrants of arrest against them.
Jo Christin and James Christopher Lim Napoles sought judicial determination of probable cause to prove there is no merit to their cases.
Sandiganbayan executive clerk of court Renato Bocar said the motions of Enrile and Napoles’ children will not delay the proceedings since the justices already know what to do.
Meanwhile, Bocar downplayed questions on the credibility of the justices handling the pork scam cases.
The charges against Enrile went to the 3rd Division headed by Presiding Justice Amparo Cabotaje Tang, with Associate Justices Samuel Martires and Alex Quiroz as members.
Bocar said that while Cabotaje-Tang and the others are President Aquino’s appointees, they have a sworn duty to be fair.
