Luy camp refers subpoena for digital records to NBI

MANILA - Whistleblower Benhur Luy was not able to submit to the Senate Blue Ribbon Committee a soft copy of his digital records on the pork barrel scam.

Luy's lawyer said he is referring the subpoena instead to the National Bureau of Investigation's (NBI) cybercrime division which is in possession of Luy's hard drive.
Blue Ribbon Committee vice chairperson Sergio Osmeña does not see this as a defiance of the Senate's subpoena, saying that a new subpoena directed to the NBI could be issued.

Osmeña said he would also suggest that committee chair Teofisto "TG" Guingona III call up the NBI director.
"Call up the NBI director and ask, 'How do you want me to do this? Should I send you a subpoena?'" Osmeña said, when asked what he would advise Guingona to do.
Osmeña underscored the importance for the committee to subpoena Luy's digital records, saying it is a "more accurate list" than Napoles' list.
"Because I think it's a bigger list. The one of Napoles is from memory and then hinahabol niya kung anumang files niya ang mayroon sa opisina niya. Those are a lot of files if you are going back to the year 2000. Now, on the other hand, I am of the belief that Benhur Luy was already copying this from the beginning to his hard disk drive. So that's a more accurate list," Osmeña said.
Asked about the request of Justice Secretary Leila de Lima to delay the publication of Napoles' signed affidavit if it is delivered tomorrow, Osmeña said that while he would rather have it released, he would first have to discuss with Guingona if de Lima has valid reasons.
"My principle has always been transparency. If there is no rule to the contrary, protecting the rights of the accused, I'll always release it," Osmeña said. "The secretary of justice must have valid reasons for making that request. So we must consider her reasons."

Senate Majority Leader Alan Peter Cayetano would not mind delaying the release of the signed affidavit but not for a long time. He reiterated his call for the continuation of the Senate inquiry on the PDAF scam.
"I agree with her (de Lima) with the caveat na dapat mag-hearing kaagad kasi the longer na hindi ito lumalabas, lumalaki ang suspetsa ng tao na binabago ito," Cayetano said.
