Court orders arrest of 8 PCG men linked to death of Taiwanese fisherman

MANILA - A Basco, Batanes court has ordered the arrest of 8 Philippine Coast Guard men involved allegedly in the Balintang Channel incident last May 9, 2013 that led to the death of a Taiwanese fisherman.

Basco, Batanes Regional Trial Court Branch 13 Judge Ramon Barona said he “examined the records of the case and formal certification [from the Department of Justice] and found to have sufficient actual and legal basis.”

The eight are:

Commander Officer Arnold Enriquez de la Cruz
Seaman First Class (SFC) Ebrando Quiapo Aguila
SFC Mhelvin Aguilar Bendo II
SFC Andy Gibb Ronario Golfo
SFC Sunny Galang Masangcay
SFC Henry Baco Solomon
Seaman Second Class Nicky Renold Aurello
Petty Officer 2 Richard Fernandez Corpuz

The DOJ earlier filed homicide charges against the 8 who supposedly “acted in unison with the common purpose of firing at the Guang Da Xing 28 to force it to submit to [the PCG’s] MCS-3001’s inspection.”

The DOJ said the National Bureau of Investigation (NBI) established conspiracy “when it presented the fact that orders were given and the orders were obeyed and efficiently implemented with fatal consequences…That they all acted with that common purpose is crystal clear. When there is conspiracy, the act of one is the act of all.”

Barona’s order was dated April 7, but was postmarked April 15. The DOJ received the copy only yesterday. – from a report by Ina Reformina, ABS-CBN News
