MANILA – A former revenue officer of the Bureau of Internal Revenue (BIR) has filed criminal and administrative charges against BIR Commissioner Kim Jacinto Henares and Deputy Commissioner Estela Sales before the Office of the Ombudsman on Wednesday.
Othello Dalanon filed charges of grave misconduct and gross neglect of duty against the Henares and Sales, according to his legal counsel Atty. Stephen Cascolan.
The case stemmed from the alleged failure of the two top BIR officials to collect from a company its 2007 deficiency tax assessment amounting to P1.56 billion.
In his complaint affidavit, Dalanon said he resigned on June 24, 2013 because of alleged irregularities he discovered while he was still with the BIR.
Cascolan said his client had written to President Aquino, asking him to intervene and order the BIR to collect the tax deficiency before the prescribed period lapses.
Meanwhile, Henares said it would not be a problem if Dalanon filed a complaint against her.
Henares said all she has to do is tell the truth.
According to the BIR commissioner, it was Dalanon who erred in his computation.
Even the company’s management found Dalanon’s assessment to be farfetched, she added.
Henares said she asked for a re-audit by another team, which found Dalanon’s assessment to be excessive.
Just to be sure, Henares said she asked for a second audit from another team, which also showed that Dalanon’s computation was wrong. -- From a report by Robert Mano, dzMM
