MANILA, Philippines – Controversial celebrity ex-doctor Hayden Kho filed on Friday before the Pasig Regional Trial Court a motion to dismiss for lack of legal basis the case filed against him by actress Katrina Halili due to lack of evidence.
In their motion of demurrer, Kho's lawyers said the Halili's camp does not have enough legal evidences to pin him down.
Kho is the central figure in the sex video scandal that rocked the entertainment industry in 2009. His medical license was revoked as a result of the controversy.
Halili filed the criminal case against Kho after their sex video, which she claimed was taken without her consent, spread on the Internet.
In a text message sent to ABS-CBN News, Halili’s counsel Atty. Raymond Palad said Kho is just delaying the resolution of the case by filing the motion. He further said that if Kho really wants to speak, the court is the right place for it, under oath.
“The intention to file a demurrer to evidence is another dilatory tactic of the defense to further delay the resolution of the case. Hayden filed before a motion to determine probable cause and to dismiss the case which was denied by the court.
"Now, they want the case to be dismissed again. It seems Hayden is just afraid to sit on the witness stand. The defense should present their client and be cross-examined. If he wants to air his side, this is the time to speak, under oath.
"Hayden admitted during the Senate hearing of May 28, 2009 that he took and recorded the sex video without Katrina's knowledge. Hayden, through same counsel, is denying it. Hayden should face what he did to Ms. Halili in court, under oath,” Palad said.
During the recent launch of Kho's perfume business in Makati City, Kho’s rumored girlfriend Dr. Vicki Belo called on the public to give Kho a chance.
“Ang number one love niya [ay] ’yong medicine. Nagpe-pray pa rin kami na maibalik ang lisensiya,” Belo said.
