Vhong's camp confident court will junk rape complaint
MANILA -- (UPDATED) Former pageant contestant Roxanne Cabanero on Thursday attended the preliminary investigation of the Pasig City Prosecutor's Office into the rape complaint she filed against actor-host Vhong Navarro.
Upon her arrival, an angry Cabanero immediately looked for Navarro, who was represented in the probe by his legal counsel, Atty. Alma Mallonga.
Cabanero, who was accompanied by her lawyer, Atty. Virgilio Batalla, demanded that Navarro face her as she reiterated her allegations of rape in April 2010.
"Is he here? I'm expecting him today, but I'm not sure if he's here. I want to see him," Cabanero said, speaking with reporters. "May ginawa siyang kasalanan sa akin. Ni-rape niya ako. I have a lot of hate inside right now and I'm very emotional, so I wanted to see that guy."
Asked for her reaction to criticisms since coming out with her allegations against Navarro, Cabanero turned emotional as she admitted that "it really hurts."
"Totoo naman 'yung pinaglalaban ko, e. Tapos lumalabas na ako pa 'yung masama," she said, before excusing herself from interviews and proceeding to the preliminary investigation.
Through his lawyer, Navarro submitted his counter-affidavit, which included sworn statements by three dancers, the actor's personal assistant and brother, as well as the producer of a concert which the actor took part in on April 24, 2010, night the rape allegedly happened.
The affidavit of comedian Vice Ganda, who headlined the concert in Cavite, was also submitted as an attachment.
While Cabanero did not file a reply affidavit, the former pageant contestant's camp submitted a manifestation clarifying that her complaint made no mention of the exact date the alleged sexual assault happened.
Batalla said that while Cabanero's complaint-affidavit specifically mentions that she and Navarro met on April 24, 2010, the subsequent events detailed, including the rape, had no dates attached to them.
Asked when the alleged rape took place, if not on the date shown in the complaint, Batalla earlier said, "During the time of April 24, 25, 26, and 27."

Noting the rape case has been submitted for resolution, Mallonga belitted the manifestation submitted by Cabanero's camp.
"I have to tell you na napakaklaro sa investigation data form -- doon nakapirma, under oath iyon, at very specific, at ito'y parte ng complaint-affidavit: nakalagay doon 'April 24.' Malinaw na malinaw," she said, noting this to be the reason why Navarro filed a perjury case against Cabanero last March 6.
Mallonga was referring to the handwritten answer to the date of commission in Cabanero's complaint-affidavit, which says "April 24, 2010, 11-pm to 1:AM".
"So kung ano man 'yung manifestation na nakalagay, wala hong kahalagahan iyon sa aming opinyon," the lawyer said, adding that they remain confident that the rape case will be dismissed.
"Given na napakaklaro na walang nangyari noong April 24 at talagang walang nangyari kahit kailan, we are very confident na ang kaso na ito, which is now submitted for resolution, ay mababasura."
Cabanero's filed her rape complaint against Navarro amid the controversy surrounding a January 22 mauling incident which left the actor with serious injuries.
She denied having any ties with any of the eight respondents in the criminal charges filed by Navarro, including businessman Cedric Lee and model Deniece Cornejo, adding she does not want her to case to be affected by the legal battle in relation to the mauling in Taguig.
The Pasig City Prosecutor's Office is set to hold a hearing on Navarro's perjury complaint against Cabanero in the coming weeks. -- with reports from Atom Araullo, ABS-CBN News; Zhander Cayabyab, DZMM
