BIR files tax evasion cases vs Panabo City trader

MANILA, Philippines - The Bureau of Internal Revenue (BIR) filed tax evasion charges on Thursday against a trader from Panabo City, Davao Del Norte who has allegedly evaded payment of income taxes amounting to P172.80 million.

Charged before the Department of Justice (DOJ) was Ernesto Y. Yap of Deco Commercial. Yap is engaged in the sale of hardware and construction materials.

The BIR conducted a tax audit on Yap pursuant to a Letter of Authority.

According to the complaint, 3rd party information obtained from Holcim Phils., Inc. revealed that Yap made purchases from the company in 2009 and 2010 amounting to P82.45 million and P86.04 million, respectively but failed to declare these.

Based on his declared gross income for 2009 and 2010, Yap allegedly only earned P4.84 million and P5.29 million for said years, the complaint stated.

Two separate complaints were filed against Yap -- the 139th and 140th filed under the BIR's Run After Tax Evaders (RATE) program under the Aquino administration.

Yap has yet to receive a copy of these complaints.
