Court asks SM for proof to halt transfer of MRT-LRT terminal

MANILA, Philippines – The Pasay Regional Trial Court on Tuesday heard the petition for injunction filed by SM Prime against the Department of Transportation and Communications (DOTC) and the Light Rail Transit Authority (LRTA), as the mall giant seeks to stop the government agencies from constructing the MRT-LRT common train station at Ayala Land’s Trinoma mall.

Last week, SM Prime sued the DOTC and the LRTA for alleged breach of contract on the location of the common train station. SM Prime argued it has a NEDA-ICC approval back in 2009 to build the common train station at SM North EDSA mall.

However, DOTC said that approval expired and government will generate savings of P1 billion if the station is built near Trinoma.

Both camps presented evidence as the hearing lasted for about two hours under the sala of RTC Judge Wilhelmina Wagan of branch 111.

However, no injunction was handed down as Judge Wagan asked SM Prime for more evidence as to why it needs the said injunction.

The court also asked DOTC, LRTA to submit its written opposition by Monday, June 16.
