Tax raps filed vs Malampaya Fund project contractor

MANILA, Philippines - The Bureau of Internal Revenue (BIR) has filed a tax evasion case against a Malampaya Fund project contractor.

In a statement, the BIR said it filed a criminal complaint with the Department of Justice against Ulysses Palconet Consebido, proprietor of Seven Digit Construction and Supplies, for willful attempt to evade tax payment and deliberate failure to provide correct information in his annual income tax returns and monthly VAT returns in 2008 and 2009.

The BIR assessed Consebido with a deficiency tax liability of P93.57 million, inclusive of surcharges and interests.

Seven Digit Construction and Supplies, which is based in Puerto Princesa City, was tapped by the Palawan provincial government to construct several infrastructure projects funded by the Malampaya Fund in 2008 and 2009.

The BIR investigation showed Consebido only declared gross revenues of P2.71 million in 2008 and P11.35 million in 2009.

However, documents gathered by the BIR investigatorss howed Consebido received income payments from Palawan provincial government -- P54.86 million in 2008 and P9.19 million in 2009.

He also received P19.32 million in 2008 and P0.39 million in 2009 as income payments from the Department of Public Works and Highways (DPWH) – Palawan II District Engineering Office.

Based on BIR Form No. 2307 (Certificate of Creditable Tax Withheld) submitted by the Office of the Provincial Treasurer, Consebido also received P3.50 million in 2009 as income payment.

The BIR said their findings showed Consebido's gross revenues amounted to P74.12 million for 2008 and P13.07 million for 2009. This meant his 2008 income was under-declared by P71.41 million in 2008 and by P1.73 million in 2009.
